Summary of the legal position on flytipping
(Kindly provided by the Enforcement Department at Lewisham Council).
- For fly tipping we prosecute under section 33 of the Environmental Protection Act 1990.
- It is an offence to deposit waste on any land that is not licensed by the Environment Agency.
- It is an offence to treat, keep or dispose of waste unless licensed by the Environment Agency.
- Basically waste can only be deposited at Waste Transfer Stations, Incinerators or land fill sites licensed by the Environment Agency.
- This section does not apply to domestic waste that is kept within the curtilage of the domestic property.
